Conrad Murray Not Expected To Serve Full Four Years

Legal expert Mike Cavalluzzi tells MTV News he isn't surprised by sentence but doesn't think it's justified.

<P>Though he dodged a potential four-year prison term, former <a href="http://www.mtv.com/music/artist/jackson_michael/artist.jhtml">Michael Jackson</a> physician Conrad Murray was sentenced to an equal amount of time in Los Angeles County Jail on Tuesday (November 29) in the death of the pop singer. </P><P> </P><P></p><div class="player-placeholder right" title="Michael Jackson Doctor Conrad Murray Sentenced" id="vid:714975.id:1673923" width="240" height="211"></div><p> </P><P> </P><P>But the same overcrowding problems that spared the cardiologist from doing time in a federal pen might also save him from serving his entire sentence in county as well. Shortly after the <a href="/news/articles/1675062/conrad-murray-sentence.jhtml">sentence was handed down</a> by Los Angeles Superior Court Judge Michael Pastor, Los Angeles Sheriff spokesman Steve Whitmore told <a href="http://www.eonline.com/news/jackson_family_reacts_conrad_murrays/277336" target="_blank">E! News</a> that Murray would likely end up serving "a little less than two years." Due to overcrowding, most county jail sentences are immediately cut in half, and given the 46 days credit Murray has already been given, he is looking at even less than that. </P><P> </P><P><a href="https://www.facebook.com/mtvnews/posts/199210760161755" target="_blank"><b>Do you think Conrad Murray deserved the maximum sentence? Let us know on Facebook.</b></a> </P><P> </P><P>Murray's lawyers said afterward that they believed the sentence was unnecessarily long. "Yes, of course [Judge Pastor] was harsh. He gave the stiffest penalty he was entitled to give under the law," Murray's attorney, J. Michael Flanagan, told reporters. "He was openly hostile. ... [Murray has] led 56 years of exemplary life. He was really dreading [sentencing]. I think anybody would dread going into it. He's an honorable man, and he'll get through this. The family is suffering more than Dr. Murray is. ... Dr. Murray is the provider in that family." </P><P> </P><P>Pastor had leeway in the sentencing, with options ranging from probation to the full sentence, but in a lengthy ruling from the bench, he said Murray's lack of remorse and negligent behavior called for the highest possible penalty. "He is and remains dangerous ... the request of probation is denied, the court imposes the high term of four years imprisonment in this case," Pastor said during the 90-plus-minute hearing. </P><P> </P><P>Los Angeles-based criminal defense attorney Mike Cavalluzzi told MTV News that he wasn't surprised by the sentencing but that he didn't believe it was justified. Cavalluzzi said Pastor had incentive to give the full sentence because of the prominence of Jackson and his family and to create the perception that he is tough on crime. "He gets that perception by sentencing him to the max while not having to surrender the defendant to the full sentence," said Cavalluzzi, who was not involved in the case. "He gets the self-satisfaction of being perceived as being tough on crime and making the Jackson family happy, but I don't think it was a fair sentence." </P><P> </P><P>Cavalluzzi said when deciding prison versus probation, judges have to look at someone's criminal history and whether a person is likely to complete the terms of their probation, which he believes Murray would. "I'm not seeing aggravating factors here, and I think it was just a chapter in [Murray's] life and he does not have a history of being a mercenary doctor always after money, but of being a good, responsible doctor who was seduced by the celebrity and money that Jackson offered," he said. </P><P> </P><P></p><div class="player-placeholder right" title="Michael Jackson's Former Doctor Guilty Of Involuntary Manslaughter" id="vid:708788.id:1673923" width="240" height="211"></div><p> </P><P> </P><P>As to why Pastor gave such a dramatic, lengthy explanation for why he was sentencing Murray to the max, Cavalluzzi said the judge has to have a justification for his actions in the public record. "Because he doesn't have the discretion to give a high prison term, [Pastor] has to justify his sentence in the record and have very specific reasons for it. I don't think there's any way that anyone truly believes that from this day forward Dr. Murray truly represents a threat to society. That's just ludicrous." </P><P> </P><P>And while he doesn't agree with the four-year term, Cavalluzzi said the high-profile nature of the case and the glare of the media could have played into the sentence. "It probably gives [<a href="/news/articles/1675068/conrad-murray-sentencing.jhtml">Jackson's family</a>] great comfort to have someone to blame," he said. " 'If not for this awful man, my son, brother, father would be alive.' But it's not fair to do that and it feels like a capitulating judgment in favor of feeding the emotional needs of the family." </P><P> </P><P>Upon leaving the courthouse, Michael's brother Jermaine, when asked if the four-year sentence was enough, shook his head and said, "No." Mother Katherine Jackson told local TV station KTLA, "Four years is not enough for someone's life. It won't bring him back. But at least he got the maximum, and I thought the judge was very, very fair." </P><P> </P><P>The prosecution, however, was satisfied with the ruling. </P><P> </P><P>"We're pleased. That's what we thought was appropriate. The judge obviously agreed with us," deputy district attorney David Walgren said. "It was our position that it was not a simple, one-time mistake; it was a series of mistakes culminating in the abandonment of Michael Jackson when he died ... the judge agreed with that sentiment. A brother and a son and a family member was killed, and whatever the sentence may be, the family of the victim deserves justice. And we did everything to bring them that justice." </P><P> </P><P>As for how much time Murray will spend locked up, Cavalluzzi said it is likely to be less than two years and, frankly, he predicted, the doctor could be out even sooner than that. "He might be eligible for house arrest very quickly," he said.</p>

Of course, between those two events, there's also going to be a presidential election, the London Olympics and that last "Twilight" movie (finally x 100!), not to mention a whole lot of activity within the lives of your favorite stars, too: Babies, weddings, honorary doctorates in nanotechnology; <i>this</i> is the year it'll all happen. </P><P> </P><P></p><div class="player-placeholder right" title="2012 Star Predictions" id="vid:722495.id:1672369" width="240" height="211"></div><p> </P><P> </P><P>Which is why, with the new year upon us, I've decided to get my <a href="http://www.amazingkreskin.com/" target="_blank">Kreskin</a> on with these predictions for 2012. Don't ask me to gaze deep into my crystal ball and try to foresee who'll win the White House or the World Series, because, seriously, if I knew that, don't you think I'd be wagering right now? Instead, I'm tackling the <i>important</i> topics. Her hits will include "Toaster," "KitchenAid Tilt-Head Stand Mixer" and "This Towel Set Someone Gave Russell and I for Our Wedding That We Keep in the Guest Bathroom." </P><P> </P><P>&#187; <a href="/music/artist/dr_dre/artist.jhtml">Dr. Dre</a> will indefinitely scrap <i>Detox</i> and instead drop a more age-appropriate album called <i>The Chronic Arthritis.</i> </P><P> </P><P>&#187; <a href="/music/artist/lady_gaga/artist.jhtml">Lady Gaga</a> will wear a crazy hat or something. </P><P> </P><P>&#187; <a href="/music/artist/rihanna/artist.jhtml">Rihanna</a> will release six albums in 2012, each more raunchy than the last. Titles include <i>Speculum,</i> <i>[Censored] [Censored] On My [Censored],</i> and <i>Songs About F---ing,</i> which, oddly, will be a note-for-note remake of Big Black's <i>Songs About F---ing.</i> </P><P> </P><P>&#187; Dave Grohl is sure to do something awesome. </P><P> </P><P>&#187; <a href="/music/artist/drake/artist.jhtml">Drake</a>'s sweater game will become so advanced that he will surpass Bill Cosby as the world's foremost expert on multi-hued knitwear. On a related note, he will also release a comedy album called <i>To Russell, My Brother, Whom I Slept With.</i> </P><P> </P><P>&#187; <a href="/music/artist/minaj__nicki/artist.jhtml">Nicki Minaj</a> will stun the fashionistas when she appears at the annual Met Ball wearing a nice pantsuit she bought at Bealls. </P><P> </P><P>&#187; <a href="/music/artist/bieber_justin/artist.jhtml">Justin Bieber</a> will finally get that bike without the training wheels, since he's a big boy now. </P><P> </P><P>&#187; <a href="/music/artist/black_keys/artist.jhtml">The Black Keys</a>, buoyed by the success of their <a href="http://www.mtv.com/videos/the-black-keys/706819/lonely-boy.jhtml">"Lonely Boy" video</a>, will shoot another dance-only clip for "Gold on the Ceiling," this one set at Gallagher's 2000 and featuring nothing but topless women. Surprisingly, it will become the most-viewed music video in the history of everything. </P><P> </P><P>&#187; <a href="/music/artist/lil_wayne/artist.jhtml">Lil Wayne</a> will come full circle, get a tattoo <i>of</i> his face <i>on</i> his face. </P><P> </P><P>&#187; <a href="/music/artist/guns_n_roses/artist.jhtml">Guns N' Roses</a> will reunite at the Rock and Roll Hall of Fame induction ceremony in April, only with that dude who plays a guitar shaped like a foot filling in for Slash and Tommy Stinson replacing Duff on bass. So, actually, it won't be Guns N' Roses at all. </P><P> </P><P>&#187; <a href="/music/artist/coldplay/artist.jhtml">Coldplay</a>'s Chris Martin is just going to be fingerpainting everything. </P><P> </P><P>&#187; <a href="/music/artist/ross__rick__rap_/artist.jhtml">Rick Ross</a> will be named the Memphis Restaurant Association's Restaurateur of the Year for his tremendous achievements in <a href="http://newsroom.mtv.com/2011/08/05/rick-ross-wingstop">Wingstop-ery.</a> </P><P> </P><P>&#187; <a href="/music/artist/west_kanye/artist.jhtml">Kanye West</a> will <i>literally</i> explode. </P><P> </P><P>&#187; Fans of <a href="/music/artist/skrillex/artist.jhtml">Skrillex</a> will stop and realize that, in 1997, EDM was poised take over America too, and we ended up with Limp Bizkit as a result.</p>

According to People and Us Weekly, Mila Kunis and Ashton Kutcher are ready to take things to the next level. They’re reportedly engaged! Neither Mila’s nor Ashton’s rep has confirmed this news. People seems to be pretty cautious about their reporting, though, so I’m inclined to believe it. They have pictures (sorry, I don’t have the rights!) of Mila flashing an impressive piece of bling on her finger. It certainly LOOKS like an engagement ring. A “business source” close to Ashton told People last December:

Ashton and Mila have talked about getting married for quite a while.” Adds another Kutcher pal: “They’re incredibly happy together.”

Mila and Ashton have been dating for two years. His drawn-out divorce from Demi Moore likely forced them to take things slowly, but they made it through together, so that’s a good sign, right? Assuming this news is true, congratulations to Mila and Ashton!

Adele posed for an elegantly put together Mert Alas and Marcus Piggott shot spread while talking about everything from ridding of the booze to her highly publicized vocal cord surgery.

Highlights from Adele’s interview are as follows.

On her ‘loud’ personality:
“I am quite loud and bolshie,” she says (British slang for unruly and clamorous). “I’m a big personality. I walk into a room, big and tall and loud.” Indeed. There is no doubt when Adele is in the building. The rule of thumb for protecting one’s vocal cords, she tells me, is: If people are more than an arm’s length away, you shouldn’t talk to them. “But I am like, Wah! Wah! Wah!,” she says, laughing. “It’s really bad.”

On giving up drinking last May:
“Don’t like drinking anymore. I think I got it out of my system. D’yaknowhaImean?”

On her vocal troubles:
“I’ve been singing properly every day since I was about fifteen or sixteen and I have never had any problems with my voice, ever. I’ve had a sore throat here and there, had a cold and sung through it, but that day it just went while I was onstage in Paris during a radio show. It was literally like someone had pulled a curtain over it.” She flew to London the next morning to see her doctor and was diagnosed with acute laryngitis. After a couple weeks’ rest, she continued her European tour, came to America, and then her voice went again in May. “That was a hemorrhage… a burst blood vessel on my vocal cord. That healed, I did a tour, and then it happened again at my best friend’s wedding on October 1.”

On getting support through her surgery from other artists:
“John Mayer had it done at the same time as I did and he really helped me be chilled out about it. Roger Daltrey’s had loads of stuff done; Steven Tyler reached out; Elton John. Lots of artists have had problems with their voices, but you don’t know about it. And they are still singing incredibly well in their 50s and 60s.”

On her six Grammy nominations:
“I burst into tears when I found out. And I would love, absolutely love, to win. This record is coming to an end, and that would be the final brick on it.”

Adam Lambert's 'Whole Lotta Love': The Story Behind The Cover

Glam rocker tackled the legendary 1970 Led Zeppelin song for 'American Idol' rock night.

<P>Imagine a freight train speeding toward you at midnight. Or a rockslide barreling down a hill as you try to outrace it. That's the feeling of the ominous, chugging Jimmy Page riff that kicks off <MTVNLINK type="url" id="http://www.mtv.com/music/artist/led_zeppelin/artist.jhtml">Led Zeppelin</MTVNLINK>'s 1970 Stonehenge of rock, "Whole Lotta Love." And that's before singer Robert Plant leans into one of the nastiest, ecstatic rock screams this side of the Who's "Won't Get Fooled Again." </P><P> </P><P>That's the song Adam Lambert chose to sing on <a href="/news/articles/1610708/adam-allison-shine-on-idol-rock-night.jhtml">"American Idol" rock night</a> Tuesday (May 5), and, needless to say, it was a challenge that the eyeliner-loving Los Angeles stage veteran was more than up for, hitting a series of high notes and rock screams that would have made Plant proud. It was a risky maneuver that paid off for Lambert, who chose a tune that came in at #75 on <I>Rolling Stone</i> magazine's list of the "500 Greatest Songs of All Time" in 2004. </P><P> </P><P></p><div style="margin: 0px 10px 10px 0px; float: left;"> </P><P><embed src="http://media.mtvnservices.com/mgid:uma:video:mtvmusic.com:84215" width="256" height="223" type="application/x-shockwave-flash" flashVars="dist=http://www.mtvmusic.com" allowFullScreen="true" AllowScriptAccess="always"></embed></div><p> </P><P> </P><P>The legendary British rock act recorded the tribute to Chicago blues icon Willie Dixon during their second U.S. tour after working it out in their live show, including it on their 1969 classic album <I>Led Zeppelin II.</i> Like many of the songs Zeppelin performed early in their career, "Love" was a blues standard turned on its head with a heavy dose of crunching psychedelic guitar and thundering drums, courtesy of late drummer John Bonham. The song was based on a 1962 tune by another blues forefather, Muddy Waters, called "You Need Love," which was penned by Dixon. </P><P> </P><P>For Zeppelin's version, Plant customized the lyrics by adding some lyrical quotes from a few other songs Dixon wrote for Howlin' Wolf, "Back Door Man" and "Shake For Me," nailing the tricky vocal in a single take. It was also inspired by 1966's "You Need Loving" from the British rock group the Small Faces, for whom Zeppelin had great affection, but they also did not credit Dixon for his part in writing the original lyrics. The song became Zeppelin's first U.S. single and their only U.S. top 10 hit. Though their manager would not let them release singles in the U.K. because he thought it cannibalized album sales, the song was finally released as the band's only British single in 1997. </P><P> </P><P>Dixon sued Zeppelin over the song in 1985, claiming it borrowed too heavily from his "You Need Love," and Zeppelin reached an agreement with him, with Dixon using the money he received to set up a program that provided musical instruments for schools. A cornerstone of heavy rock, the tune -- which was the theme song for the long-running British countdown show "Top of the Pops" in the 1970s and '80s -- has been covered by dozens of artists over the years, from Tina Turner and Ben Harper to Prince, Slash, Leona Lewis, Train's Pat Monahan, the London Symphony Orchestra and Jane's Addiction. </P><P> </P><P><b>Get your "Idol" fix on MTV News' <a href="/news/articles/1486475/mtv-news-american-idol.jhtml">"American Idol" page</a>, where you'll find all the latest news, interviews and opinions.</b></p>

Are Madonna And Britney Spears Collaborating On MDNA?

Amid rumors that Spears will appear on Madge's 'Girls Gone Wild,' MTV News looks back at their history together.

<P>Could it be that <a href="http://www.mtv.com/music/artist/madonna/artist.jhtml">Madonna</a> has enlisted her pal <a href="http://www.mtv.com/music/artist/spears_britney/artist.jhtml">Britney Spears</a> for <a href="/news/articles/1678197/madonna-mdna-album.jhtml"><i>MDNA</i></a>? </P><P> </P><P></p><div class="player-placeholder right" title="Britney Spears, Madonna Get In The Zone For 'Me Against The Music' Video" id="vid:623135.id:1657989" width="240" height="211"></div><p> </P><P> </P><P>Well, according to a leaked album jacket, it seems that Spears is making an appearance on the album's lead track, "Girls Gone Wild." </P><P> </P><P>This would mark the second collaboration on the album. Madonna nabbed Nicki Minaj and M.I.A. for the album's first single, <a href="/news/articles/1678478/madonna-give-me-all-your-luvin-video.jhtml">"Give Me All Your Luvin'."</a> </P><P>While the leaked jacket, which appeared on Britney fansite <a href="http://www.breatheheavy.com/2012/02/britney-on-new-madonna-album/?utm_medium=twitter&utm_source=twitterfeed" target="_blank">Breatheheavy.com</a>, can't be confirmed as authentic, a rep for Madge had no comment about the rumor, neither confirming nor denying it. Meanwhile, a rep for Spears never returned MTV News' request for comment. </P><P> </P><P>This is hardly the first time that the two ladies have worked together. In fact, they have quite a history with each other. </P><P> </P><P>The duo kicked off their nearly decade-long friendship at the 2003 VMAs when, in case you hadn't heard, they <a href="/news/articles/1669706/britney-spears-mtv-vma-history.jhtml">shared an onstage kiss</a> while performing together. It was the kiss seen and heard around the world, and nearly 10 years later it is still often talked about as one of the most memorable moments in the show's storied history. </P><P> </P><P>After they shared that smooch, Spears was inspired to get the Queen of Pop on her lead <i>In the Zone</i> single, <a href="/news/articles/1658075/britney-spears-me-against-the-music.jhtml">"Me Against the Music."</a> "I was in the middle of rehearsals for the VMAs and I played her the song, and she was like, 'That's your first single, right?' " Britney recalled in a vintage interview with MTV. "I was like, 'Yeah, hopefully.' She was like, 'I really like it.' I was like, 'Really?' I was like, 'Well, you wanna do it with me?' She said, 'Yeah.' " </P><P> </P><P>They later appeared together in the warehouse-set video with one another, playing a pop star cat-and-mouse game that featured a near kiss. </P><P> </P><P>Five years later, as Spears was prepping her return to the pop spotlight, she appeared <a href="/news/articles/1598804/britney-spears-justin-timberlake-appear-onstage-with-madonna.jhtml">onstage with Madonna</a> during a Sticky &amp; Sweet Tour stop at Dodger Stadium in Los Angeles. The singer hit the stage with the pop icon to perform "Human Nature" by her side. </P><P> </P><P>That same year, Madonna appeared in <a href="/news/articles/1600361/britney-spears-talks-breakups-breakdowns-in-for-the-record.jhtml">Spears' documentary, "For the Record,"</a> where she spoke about the younger singer. "I admire her as an artist," the Material Girl said, adding that she sees a lot of herself in Spears. </P><P>In 2011, as Spears was prepping the release of her album <i>Femme Fatale,</i> in an <a href="/news/articles/1659522/britney-spears-plastic-surgery-out-magazine.jhtml">interview with <i>Out</i> magazine</a>, she noted that she truly admires her friend. "Madonna. No question. She is an amazing entertainer," she said when asked whose career she most would want to emulate. </P><P> </P><P>As Madonna preps the release of <i>MDNA</i> in March, Spears is also the topic of conversation in a recent interview with her. When asked by ABC News what it was like to smooch the pop princess, she commented, "Nice moment, good kisser. Cool," she said, clarifying that she wouldn't do it again. "No, I already did it. Selena Gomez's Shy Arrival at LAX

Keeping it casual in LA, Selena Gomez arrived at LAX after a flight out of town on Wednesday (February 26).

Showing up incognito, the "Fly to Your Heart" singer sported black leggings and a tank top, wearing a loose olive-colored coat down around her shoulders, looking disinterested in the cameras around her.

However, the 21-year-old stopped to sign a photo for a fan as she made her way outside, and although it is not known where she went, Selena was in LA over this past weekend.

In related news, troubled pop star Justin Bieber is rumored to be overflowing with jealousy over Selena going on dates with One Direction member, Niall Horan.

He is reportedly trying to leave Selena out of his upcoming birthday celebration, and an insider stated, "Justin is planning a huge party for his 20th birthday and he has not invited Selena. He does not want her there after she dissed him by hooking up with Niall, which was not cool according to Justin," adding, "There will be plenty of hot chicks there, and let's just say lots of party favors...It's going to be off the hook."

Them Crooked Vultures make their debut with a post-Lollapalooza set.

<P>Officially, <a href="/news/articles/1617945/janes-addiction-killers-turn-up-heat-on-lollapaloozas-last-day.jhtml">Lollapalooza ended Sunday night</a> in Chicago's Grant Park, with dueling sets from <a href="/music/artist/killers_the/artist.jhtml">the Killers</a> and <a href="/music/artist/janes_addiction/artist.jhtml">Jane's Addiction</a>. Unofficially, it ended <i>very</i> early Monday morning, across town at venerable rock club the Metro, with a surprise show by Them Crooked Vultures. </P><P> </P><P>To the unfamiliar, the Vultures might seem like an odd choice to close out Lolla weekend ... until you realize that they're made up of <a href="/music/artist/foo_fighters/artist.jhtml">Foo Fighters</a> frontman/ former Nirvana drummer Dave Grohl, <a href="/music/artist/queens_stone_age/artist.jhtml">Queens of the Stone Age</a> mastermind Josh Homme and <a href="/music/artist/led_zeppelin/artist.jhtml">Led Zeppelin</a> legend John Paul Jones. And their gig at the Metro was their world premiere. </P><P> </P><P>According to <a href="http://blogs.suntimes.com/derogatis/2009/08/them_crooked_vultures_at_metro.html" target="_blank">some reports</a>, the Vultures actually turned <i>down</i> Lollapalooza founder Perry Farrell's request to replace the Beastie Boys as headliners at the festival, opting to debut in front of some 1,100 super-psyched fans at the Metro, rather than 75,000 in Grant Park (tickets for the gig were announced via Foo Fighter/ QOTSA fan clubs). Meaning that, in a lot of ways, this was the most sought-after ticket in town. </P><P> </P><P>Taking the stage just after midnight, the Vultures &#8212; Grohl on drums (of course), Homme on guitar and vocals, Jones on bass and keys and frequent QOTSA contributor Alain Johannes on guitar &#8212; ripped through 12 songs in 80 minutes, all taken from their upcoming debut, which may or may not be called <i>Never Deserved the Future,</i> and may or may not be hitting stores on October 23 (early "promo" videos touting both those facts were revealed over the weekend to be hoaxes perpetrated by QOTSA fans). </P><P> </P><P>The songs, with appropriately Homme-ian titles like "Scumbag Blues," "Mind Eraser (No Chaser)," "Caligulove" and "Interlude w/Ludes," sounded pretty much how you'd expect, given the band's pedigree. They rocked, hard &#8212; <a href="http://leisureblogs.chicagotribune.com/turn_it_up/2009/08/concert-review-them-crooked-vultures-at-metro.html" target="_blank"><i>Chicago Tribune</i></a> critic Greg Kot described them as "fresh, invigorating and just plain nasty" &#8212; delving off into psychedelic, reverb-filled excursions and exploring proggy territory, "both of the old-school Yes variety, and the more modern Tool flavor," according to the <i>Chicago Sun-Times'</i> Jim DeRogatis. </P><P> </P><P>It's not known if Monday's Metro performance was a one-off event for the Vultures &#8212; there have been whispers of a full-blown tour, but a spokesperson for Homme had not responded to MTV News' request for comment at press time. Nor was it clear whether or not they'll have an album out in October. </P><P> </P><P>Early Monday, a <a href="http://twitter.com/crookedvultures" target="_blank">Crooked Vultures Twitter account</a>, which had previously posted links to the band's <a href="http://www.themcrookedvultures.com/" target="_blank">official-looking Web site</a> and the Metro's online ticketing site &#8212; posted a link to what appears to be the group's first bit of official merchandise: a <i>Deserve the Future</i> T-shirt. Cost: $30.</p>
